Purpose :

To lead, guide, coordinate and manage the activities of investigators and senior investigators assigned to conduct investigations relating to all or specific areas of tax and grant programs administered by the Ministry, including intelligence gathering.

To advise senior management on operational/program matters, including recommending changes to policies, procedures or legislation due to emerging trends and/or identification of policy and/or intelligence gaps in investigations.

Key Responsibilities :

1. Reviews investigation plans, allocates investigations and projects within the investigation group, monitors investigations, assesses and determines changes in investigation projects where necessary, evaluates and approves information to obtain Search Warrants, Crown Brief, draft charges and surveillance operations; and oversees the execution of search warrants, laying of charges and court appearances.
2. Reviews, monitors, assesses and determines changes in the collection, processing, analysis, dissemination and exchange of intelligence, to determine enforcement trends, and to ensure the creation of and intelligence database and enforcement tracking system; oversee tactical crime analysis, identify current crime series, hotspots, and program gaps concerning branch programs in order to provide information to senior management for decisions on mitigating risks or threats.
3. Liaises, plans, manages and coordinates joint forces operations and intelligence initiatives with other enforcement bodies (e.g. Canada Border Services Agency, Canada Revenue Agency, Ministry of Environment and Climate Change, Ministry of Health and Long Term Care, Police Agencies such as RCMP, Commercial Crime Service, O.P.P. Anti- Rackets, and City Police Service Fraud Squads, other provinces and states).
4. Briefs and advises senior management on operational/program matters, including recommending changes to policies, procedures or legislation due to emerging trends and/or identification of policy/intelligence gaps as a result of investigations; provides support and assistance directly to investigators in the compilation and analysis of confidential information regarding complex investigations; and recommends specific investigative directions.
5. Represents the branch and makes presentations to ministry staff and to enforcement jurisdictions (e.g. CBSA, CRA, Ministry of Environment and Climate Change, Ministry of Health and Long-Term Care, Policy Agencies, Commercial Crime Service, O.P.P. Anti-Rackets, City Police Service Fraud Squads, other provinces and states) on enforcement initiatives (e.g. Tobacco Outreach program) and intelligence gathering to advance investigation activity and maintain/build upon relationships with partner organizations.

MANAGERIAL RESPONSIBILITIES

1. Leads and manages a team(s) in the delivery of a program or service operation and contributes to financial, business, strategic planning and evaluation processes.
2. Identifies financial, material and human resources needs, manages and controls the operational/program/project or activities budget. Contributes to long term financial and resource planning.
3. Promotes a values-based and inclusive team through employee engagement, communicating program deliverables, setting and evaluating performance standards, recommends merit increases, identifies staffing needs, and makes hiring decisions, recommends discipline where required, and promptly addresses employee relations matters.
4. Develops and sustains internal and external stakeholder relationships to coordinate shared interests.
5. Responsible for ensuring compliance with regulatory, legal, financial, collective agreements and ministry policy commitments and advising senior management of sensitive issues/matters.

Knowledge :

Ministry strategic directions, policies, programs and service delivery models, to provide operational management of a program area, service or initiative, to determine and plan for program resource requirements and to ensure alignment of programs/projects with corporate, division and branch goals and objectives.

Human resources practices, policies, directives and collective agreements in relation to recruitment, training and development and labour relations to support an inclusive and engaged team; address employee issues and to support talent management.

Government and ministry financial and administrative procedures, to manage and control allocated financial and material resources, including developing annual budgets, and managing assets and contract service providers.

Expertise in project management principles and methodologies to manage the delivery of program plans, initiatives and goals.

Investigative techniques, judicial process, rules of evidence and court procedures and related legislation (e.g. Provincial Offences Act, Ontario and Canada Evidence Act, Charter of Rights, Criminal Code of Canada), to manage and oversee the conduct of effective investigations with a view to prosecuting offenders; and to provide advice to senior management, policy makers and others, on contentious investigative matters. .

Current case law, reports, judgments and precedents, to review/assess investigation plans and reports, and to determine whether to approve obtaining/executing search warrants, recommendations of charges and court appearances.

Relevant legislation administered by the Ministry (e.g. Land Transfer Tax Act, Gas Tax Act, Employer Health Tax Act, Fuel Tax Act, and Tobacco Tax Act), related federal/provincial regulations and ministry guidelines, to manage investigations into alleged contraventions, and ensure compliance with requirements.

Ministry/division/branch policies, procedures, inspections and practices, case law, judgments and precedents, to ensure the correct application of enforcement policies on the most complex and sensitive non-compliance matters.

Physical surveillance and video surveillance techniques, to ensure evidence is legally obtained, to support investigations of violations of ministry statutes.

Accounting theory, practices, policies, procedures, and audit standards, to understand complex business accounting systems and financial statements, to ensure consistency and appropriateness of approach.

Program Responsibility :

Responsible for leading investigation staff in the development and execution of investigation plans and strategies, the gathering of intelligence, and recommending outcomes (e.g. search warrants, charges, strategic and operational intelligence reports, briefing notes).

Manages a team of investigators in the enforcement of ministry tax statutes and other financial statutes, conducting surveillance, executing search warrants and seizing evidence.

Ensures compliance will all applicable legislation, policies and procedures by approving investigation reports; conducting investigations in complex and contentious cases; and recommending changes to legislation, policies and procedures.

Prepares and provides metric reports to senior management regarding operational performance, results, and trends.

Analytical Thinking :


Reviews/assesses operational intelligence reports, investigation plans and findings, to determine legislative and procedural compliance, appropriateness, and likelihood of a successful outcome.

Determines appropriate methodologies for gathering intelligence, to ensure viability.

Determines any required changes to investigation plans or recommendations. Identifies other organizations and jurisdictions for the development of working partnerships.

Analyses investigation issues/problems/trends/gaps, and recommends changes to policies, procedures, practices or legislation due to emerging trends and/or identification of policy/intelligence/enforcement gaps as a result of investigations.

Planning / Coordinating :

Coordinates and plans the delivery of a program, operation, service or project considering the strategy and mandate of the branch and ministry.

Determines financial, material and human resources needs, coordinates operations with other areas of the branch and division, and organizes work to meet program objectives. Participates in divisional results based and strategic planning, processes.

Coordinates consultation and advisory meetings relating to program/service initiative with external and internal stakeholders, partners and consultants.

Plans and coordinates investigations into violations of relevant tax legislation, and the delivery of a quality enforcement program, ensuring consistency of approach and application of statutes and policies with respect to investigative and enforcement activities.

Liaises, plans, manages and coordinates joint forces operations and intelligence initiatives with other enforcement jurisdictions to optimize efforts.

Contributes in planning, coordinating and managing special projects and investigations.

Plans and coordinates priorities, goals and targets, and resource schedules.

Manages the review of relevant operational policies and procedures, and the development of recommendations for improvement.

Exercises discretion and independent judgement to determine and manage work activities where past practices may not exist.

Work is performed under general direction and within the broad framework of tax statutes, related regulations, Criminal Code of Canada, Provincial Offences Act, Chart of Rights and Freedoms, precedents, policies, standards, program objectives, and investigative and legal processes.

Reviews and approves investigation plans, reports and recommendations, including recommendations for search warrants, charges, court appearance, and the collection of intelligence.

Determines changes required in investigation plans, reports and recommendations.

Recommends changes/improvements to operating policies and procedures, to close intelligence and enforcement gaps and optimize case management.

Interpersonal/Communication :

Communicates with senior management and investigation staff, to discuss intelligence information, investigations and strategies, resolve complex case issues, and recommend changes to operational policies and procedures.

Communicates with other ministry branches and other ministries (e.g. Ministry of Environment and Climate Change, Ministry of Health and Long Term Care), to provide briefings on investigative matters of note; and to coordinate the gathering and sharing of intelligence.

Contacts officials from CBSA, other provincial, federal and state tax jurisdictions and police agencies to provide advice and information; and to plan and coordinate cross-jurisdictional intelligence and enforcement initiatives and actions.

Negotiates with stakeholders in complex and contentious cases.

Develops and maintains partnerships with other jurisdictions to optimize investigations, intelligence gathering, and case outcomes.

Consistent with a typical office environment.

Sensory Effort :

Requires attention and intense concentration to review case recommendations for intelligence gathering, search warrants, recommendations for charges, and conditions under which intelligence was obtained. Requires concentrated effort to lead and manage the activities of investigators, senior investigators and intelligence analysts assigned to conduct investigations and intelligence probes; and to provide advice to senior management on all program matters.
