Employment standards are enforced under the Employment Standards Act, 2000, which sets out the rights and responsibilities of both employees and employers in Ontario workplaces.

What can I expect to do in this role?

In this position, you will administer, enforce and obtain compliance with the Employment Standards Act, 2000, Employment Protection for Foreign Nationals Act and related legislation by:
• conducting workplace inspections
• investigating complaints of alleged violations
• exercising quasi-judicial powers
• rendering written decisions based on established standards
• issuing orders, notices and penalties
• issuing certificates of offences, developing crown briefs and laying charges as described under the Provincial Offences Act
• delivering educational seminars to various stakeholders

Available locations include: Mississauga, Newmarket, North York and Scarborough

How do I qualify?

Mandatory

• you hold a valid class “G” driver's licence or equivalent as recognized by the Province of Ontario to travel throughout the designated service area

Enforcement experience:

• you have experience interpreting, applying and enforcing legislation
• you have experience auditing records, gathering evidence and making decisions based on established standards
• you have experience conducting inspections and investigations to identify non-compliance
• you have knowledge of court procedures (e.g. for filing documents, serving as a witness in court proceedings, etc.)
• you have experience with issuing Certificate of Offences and Part III prosecutions

Knowledge of employment standards legislation and related regulations:

• you have knowledge of the Employment Standards Act, 2000
• you have knowledge of the Employment Protection for Foreign Nationals Act
• you have knowledge of other relevant provincial and federal legislation (e.g. Provincial Offences Act, Employment Insurance, Business Corporations Act, Insolvency and Bankruptcy Act, etc.)

Communication skills:

• you have oral communication skills to interview parities, serve as a witness in court and deliver presentations and educations seminars to internal and external stakeholders
• you have written communication skills to prepare orders, notes, reports, crown briefs, decisions and various other correspondence
• you have mediation, conflict resolution and negotiation skills to effectively impact and influence the actions of others when there are differing opinions and conflicting interests
• you have interpersonal skills to sustain positive relationships with businesses, employees and other relevant parties in potentially adversarial and emotional situations

Other important skills:

• you have organizational, planning and time management skills to deliver on performance objectives
• you are proficient with a variety of common office software (e.g. databases, word processing, spreadsheet, email, internet, etc.)
