The Information and Privacy Commissioner of Ontario is an administrative tribunal responsible for the Freedom of Information and Protection of Privacy Act (FIPPA), the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA), the Personal Health Information Protection Act (PHIPA) and the Child, Youth and Family Services Act (CYFSA). Under these acts, the Information and Privacy Commissioner, Tribunal Services Division: resolves access to information appeals and complaints when government, health care practitioners/organizations and service providers refuse to grant requests for access or correction; and investigates complaints with respect to the privacy of personal information and personal health information held by government, service providers and health care practitioners/ organizations.

About the job

As a Mediator/Investigator, you will:
  • Investigate privacy complaints made by members of the public under FIPPA, MFIPPA, PHIPA and CYFSA.
  • Attempt to effect settlement of complaints made by members of the public under the FIPPA,
    MFIPPA, PHIPA and CYFSA.
  • Issue Mediator's Reports/Investigations Reports summarizing the outcome of the mediation/investigation.
  • Investigate and review certain complaints in accordance with delegated decision-making authority as assigned.
  • Improve customer service through participation in institution relations and appellant relations programs; and;

  • Mediate and investigate complaints by:
    • Interpreting a broad range of legislation administered by provincial and municipal institutions to analyze, explain and determine interface, relationships and applicability to access and correction rights;,
    • Explaining the operation of FIPPA, MFIPPA, PHIPA and CYFSA to complainants, and the purpose and process of mediation and investigation,
    • Investigating the circumstances and gathering facts surrounding complaints,
    • Attempting to resolve complaints through mediation, by ascertaining positions of the parties, investigating means of settlement, and determining mediation strategies/approaches,
    • Conducting research and analyzing past precedents,
    • Issuing a Mediator's Report summarizing the outcome of the mediation process; and/or,
    • Where possible, providing parties with advisory opinions on the likely outcome of the complaint; and,
    • Completing all required documentation.
  • Act as a delegated decision maker under FIPPA, MFIPPA, PHIPA and CYFSA by:
    • Preparing documentation soliciting written representations from the parties, analyzing past precedents, and issuing written decisions/reports with reasons.

What you bring to the team


You will qualify for this position by demonstrating:

Knowledge:
  • Post-secondary education in a related field, or an equivalent combination of education and experience.
  • Proven investigation and mediation skills.
  • Understanding of administrative law concepts.
  • Understanding of the provisions and the operation of FIPPA, MFIPPA, PHIPA, and CYFSA.
  • Proven mediation skills and a strong customer service and resolution-oriented approach to conflict situations.

Interpersonal and Relationship Management Skills:

  • Ability to establish effective working relationships with employees, management and with both internal and external clients.
  • Ability to work both independently as well as act as an effective team member.

Analytical, Research and Project Management Experience:

  • Well-developed analytical/problem solving skills.
  • Ability to plan and conduct extensive research and prepare written reports, evaluations and recommendations.
  • You can identify risks and barriers to mediation decisions.

Communication and Presentation Skills:

  • You have well-developed oral communication skills to respond to issues and provide recommendations.
  • You have strong written communication skills to prepare reports and promote initiatives to internal and external stakeholders.
  • You have experience using standard computer software applications (e.g. word processing, spreadsheet) to research and prepare materials.

Preferred Asset Qualifications:

  • You have the ability to communicate (orally and in writing) in French.

Qualified List Information:

    OPS & IPC Reciprocal Staffing Agreement:
  • The IPC has a Reciprocal Staffing Agreement with the Ontario Public Service (OPS) that enables employees to accept positions in either organization while retaining their access to benefits, pension contributions, and years of service.
    Hybrid Work:
  • Like many organizations, the IPC is considering the future of its workplace arrangements. It is developing possibilities for hybrid work and various work arrangements may be possible.
    Vaccination Policy:
  • Effective December 13, 2021, the IPC's Vaccination Policy requires all IPC employees who enter the office to provide proof they are fully vaccinated, meaning they are fully vaccinated as defined by the Ministry of Health (refer to: COVID-19 Fully Vaccinated Status in Ontario), including 14 calendar days have passed since receiving their final dose of the COVID-19 vaccine.
  • Employees who do not provide proof of full vaccination will be deemed ‘not vaccinated' under the IPC Vaccination Policy and will be required to undergo regular rapid antigen testing to enter the office, including employees with a valid medical exemption.
