Are you looking for a senior position to demonstrate your debating and negotiation skills and knowledge of highway construction, maintenance and engineering? Are you a skilled negotiator with an understanding of contracting principles and contract law? Then this position is for you! We are seeking experienced and detail-oriented professionals to join out Contract Claims team.

About the job

In this role, you will:
• lead a team of professionals in the review, analysis and settlement of construction, maintenance, engineering and contract administration claims elevated to the provincial level
• lead the preparation of complex reports on claims including mediation, referee and adjudication briefs and lead in oral meetings/hearings/etc. on claims as part of mediation, referee, and adjudication processes.
• lead the development of policies and procedures related to dispute resolution for ministry contracts to ensure a fair and equitable process for resolving claims
• act as the ministry's authoritative expert on matters related to construction, maintenance, engineering and contract administration claims.

Note: The location of the vacancy is at 301 St Paul St, St Catharines. However, pending the results of the competition, consideration will be given to the successful candidate to allow them to work out of an MTO Office in one of the cities listed on this posting.

What you bring to the team

Mandatory requirements

• You are a Professional Engineer, licensed with Professional Engineers Ontario (PEO).

Technical Expertise

• You have knowledge of civil engineering theories principles and practices related to highway construction, engineering and maintenance claims as well as contractors' methods of tendering on ministry contracts
• You have knowledge of heavy civil construction methodologies, scheduling, sequencing, as well as quality control and quality assurance, practices
• You have knowledge of contract methodology and preparation, design and documentation
• You have knowledge of principles of construction contract law
• You have knowledge of alternative dispute resolution methodologies such as arbitration, mediation, referee, adjudication and litigation

Leadership Skills

• You have demonstrated team leadership skills to provide technical guidance and leadership, including, assigning and scheduling work, monitoring work progress, resolving problems and providing guidance and technical input.
• You have experience participating in the planning, decision-making, review and problem solving for projects.

Analytical Skills

• You have investigative and analytical skills to research the background of claims, analyze technical data, evaluate different points of view, maintain objectivity and make recommendations.

Communication Skills

• You have superior communication skills, to establish and maintain effective working relationships with peers, associates and senior officials
• You have strong written communication skills to prepare a range of written materials (i.e. policies and procedures, briefing notes, reports and business cases).
• You have proven negotiation skills to negotiate with contractors/consultants including, owners, presidents, vice-presidents, financial officers, and chief executive officers, to resolve claims in a fair and equitable manner.
