The Ministry of the Attorney General, Civil Law Division, seeks an experienced litigator for an exciting and challenging opportunity to join the legal team at the Ministry of Natural Resources (“MNR-LSB”). What can I expect to do in this role?
• Preparing and conducting prosecutions and appeals under legislation administered by MNR including prosecutions related to fish and wildlife and resource development
• Occasionally representing MNR in proceedings before the Ontario Land Tribunal
• Participating in MNR's Provincial Compliance Committee which considers appropriate enforcement action in occurrences involving individuals who are Indigenous
• Considering and developing alternatives to formal prosecution, including restorative justice, in cases involving Indigenous defendants
• Providing legal opinions and advice (both oral and written) to MNR officials on compliance, enforcement and strategic issues including the review of charge wordings and search warrant applications
• Drafting briefing notes and other documents, briefing senior management, participating in policy development, and taking on special projects
• Providing litigation support to Crown Law Office Civil in cases involving MNR
• Providing training and education to MNR clients
• Participating on committees, in training, projects and administrative duties as assigned
• Travelling throughout Ontario as required
What you bring to the team
Mandatory requirements
• Membership in good standing as a lawyer with the Law Society of Ontario
Knowledge and Skills
• You have demonstrated knowledge and experience practising in criminal or regulatory law and procedure including with respect to the
Provincial Offences Act and
Charter of Rights and Freedoms, rules of evidence and case law
• You have demonstrated knowledge of Aboriginal law, an understanding of the nature of the relationship between Indigenous peoples and the government, and are sensitive to the issues facing modern Indigenous communities
• You have working knowledge of the law related to natural resource management and the management of public lands
• You have demonstrated knowledge of the roles and responsibilities of Crown counsel when conducting litigation
• You have a proven ability to handle a high-volume practice and function well under the pressure of tight timelines and unexpected or competing demands
• You have demonstrated organizational and negotiation skills
• You are a practical problem solver, good at working on teams with other lawyers and capable of handling complicated or complex prosecutions
• You have demonstrated oral and written skills, proven judgment and analytical skills
• You have a proven record of building relationships with clients and colleagues and of fostering and creating a culture of diversity, anti-racism, equity and wellness in the workplace
