The Information and Privacy Commissioner of Ontario is an administrative tribunal responsible for the Freedom of Information and Protection of Privacy Act (FIPPA), the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA) and the Personal Health Information Protection Act. Under these acts, the Information and Privacy Commissioner, Tribunal Services Division:

• resolves access to information appeals and complaints when government or health care practitioners and organizations refuse to grant requests for access or correction; and
• investigates complaints with respect to personal information and personal health information held by government or health care practitioners and organizations.

What can I expect to do in this role?

As a Mediator you will:
> attempt to effect settlement of appeals made by members of the public under the FIPPA and MFIPPA;
>adjudicate certain appeals in accordance with delegated decision-making authority as assigned;
> improve customer service through participation in institution relations and appellant relations programs;
> mediate appeals under FIPPA and MFIPPA by:

    • explaining the operation of FIPPA and MFIPPA to appellants, and the purpose and process of mediation;
    • investigating the circumstances and gathering facts surrounding appeals;
    • attempting to resolve appeals through mediation, by ascertaining positions of the parties, investigating means of settlement, determining mediation strategies and approaches;
    • interpreting a broad range of legislation administered by provincial and municipal institutions to analyze and determine their applicability to access and correction rights under FIPPA and MFIPPA;
    • conducting research and analyzing past precedents;
    • where possible, providing parties with advisory opinions on the likely outcome of the appeal;
    • completing all required documentation on the case management system; and
    • issuing a Mediator's Report summarizing the outcome of the mediation process.

> Act as a delegated decision maker under FIPPA and MFIPPA, by:

    • preparing documentation soliciting written representations from the parties, conducting research and analyzing past precedents, and issuing final written decisions with reasons for particular types of appeals; and
    • conducting oral hearings for appeals involving the issue of reasonableness of search for responsive records, and issuing a written decision with reasons for all cases which do not settle.

How do I qualify?

We are looking for a Mediator who has:

• proven mediation skills and a strong customer service and resolution-oriented approach to conflict situations;
• a good understanding of administrative law concepts;
• a good understanding of the provisions and the operation of FIPPA and MFIPPA;
• proven written communication skills;
• solid analytical/conceptual skills;
• orientation to detail;
• an ability to apply good judgement in various aspects of appeals;
• well developed oral and interpersonal communication skills;
• proven written communication skills;
• solid and effective organizational and time management skills to successfully manage a demanding caseload within established timelines; and
• an ability to use computer technology.
