ELIGIBILITY FOR THIS COMPETITION IS RESTRICTED TO STEP 1 CANDIDATES INCLUDING OPS ALOC AND OCAA LAWYERS living or working within 125 km of this location. Note: Eligible lawyers from outside the Area of Search may apply but will not be entitled to relocation or travel expenses for the transfer as set out below.

Step 1: All regular/fixed-term OCAA and ALOC lawyers on staff, current Redeployment List Members and current Articling Student Hireback Pool Members. 
Step 2: In the absence of qualified applicants at Step 1 the competition may be reposted so that external applicants or non-members of the above-mentioned groups would then be eligible to apply.

The Ministry of the Attorney General, Criminal Law Division (CLD), Complex Prosecutions Bureau (CPB) is seeking counsel for its Major Auto Theft Prosecution Response Team (MATPRT). The Bureau is a multi-faceted, comprehensive approach to ensuring Ontario's prosecution service is equipped to prosecute increasing volumes of serious and violent crime effectively and efficiently, and to ensure continued prosecutorial capacity in local Crown Attorney offices.

As part of the CPB, the MATPRT is a specialized team who will provide prosecutorial support and assistance to frontline Crown Attorney Offices across the province on major auto theft prosecutions, including prosecuting criminal organizations. This team will provide dedicated legal and prosecutorial support to the OPP and municipal police agencies to prepare and prosecute complex cases.

The Criminal Law Division provides legal representation for the Crown in right of Ontario in all criminal matters. It is responsible for the prosecution of criminal cases before all courts in the province and for the carriage of criminal appeals in the Ontario Court of Appeal and the Supreme Court of Canada. With over 1900 staff, Ontario's prosecution service is the largest in the country and is recognized as an innovative leader.

The position is based in Toronto with extensive travel across Ontario as required. Note that the specific office location will be discussed with the successful candidates during the hiring process.

What can I expect to do in this role?

Duties will include:

• Conducting prosecutions in the Ontario and Superior Courts of Justice throughout Ontario
• Assisting with research, case preparation and courtroom advocacy in complex financial crime prosecutions in the Ontario and Superior Courts of Justice throughout Ontario
• Conducting appeals in the Summary Conviction Appeal Court
• Work in the area of criminal law policy
• Work in the area of Mutual legal Assistance and Extraditions and Criminal Asset Forfeiture
• Providing legal advice to the police, the Director of the Complex Prosecutions Bureau, the Chief Counsel of the Major Auto Theft Prosecution Response Team, other ministry officials and other government departments and agencies
• Participating in educational and training sessions for prosecutors, police and other justice partners

How do I qualify?

Mandatory

• Membership in good standing as a lawyer with the Law Society of Ontario
• Oral and written French language skills at the superior level

Knowledge and Skills

• Thorough knowledge of criminal and constitutional law, including statute and case law regarding the prosecution of criminal and quasi-criminal offences at all levels
• Proven research skills and analytical ability to organize a principled approach to cases and issues
• Proficiency with technological tools for litigation; e.g. QuickLaw, SCOPE, PowerPoint, electronic case management software, etc.
• Demonstrated writing skills and trial advocacy experience
• Experience with large case management
• Proven judgment and ability to apply appropriate legal analysis and determine appropriate remedies
• Demonstrated organizational skills
• Knowledge and understanding of the role and function of prosecutor
• Integrity and demonstrated interpersonal and communication skills
