What can I expect to do in this role?

You will:

• Effectively plan, manage and control the day-to-day operation and administration of a team of Senior Investigators, Regulatory Services support staff to ensure the effective delivery of investigative services related to offences in the Workplace Safety and Insurance Act (“WSIA”), internal investigations, and inquiries leading to the referral to police for a Criminal Code investigation which includes the co-ordination of all investigative activities, and assignment of work based on sensitivity, contentious issues and the broad ramifications of each case.

• Participate with the Executive Director and the Regulatory Services management team in the development, implementation and achievement of divisional goals and objectives based on the Divisional Business Plan and the enterprise Compliance Strategy.

• Manage the business process related to investigations, develop, report on and respond to measures, outcomes and related statistical analysis related to investigations. Provide direct support in the development and presentation of the programs and services on compliance and fraud related initiatives to meet the Board's strategic direction and the Anti-Fraud and Compliance Strategy.

• Monitor, review and re-evaluate the complexity of the case and expertise of the Senior Investigator(s), discuss strategy with and charge screening with Executive Director and/or Senior Prosecutor, taking into consideration the Workplace Safety and Insurance Act (“WSIA”) and relevant policies and guidelines, the Compliance Model , resources, and time limitations. Provide updates to Principles and Procedures manual to reflect currency of business process. Undertake high profile and/or sensitive cases.

• Assist in the development and presentation of the projects, programs and services on compliance, fraud, waste and abuse to support and execute the WSIB Compliance Strategy.

• Provide technical direction and expertise to Senior Investigators and project teams at various stages in the investigation of wrongdoing by injured workers, employers, suppliers, providers, representatives, and employees of the Board ensuring procedural fairness, confidentiality, and objective decision making. Review investigative reports, Information to Obtain Search Warrant, and charging documents (Informations) for accuracy, sufficiency and clarity of information, and admissibility of evidence.

• Participate in the recruitment and hiring of staff, provide technical advice and direction, promote professional development and self-improvement programs for staff, set performance objectives for direct reports and review performance with staff, share new information and process; respond to FIPPA requests for investigative documents; handle minor disciplinary matters and implement programs to encourage personal and staff behaviour that supports the desired culture of maintaining the integrity of the system, excellent customer service, team work, and health and safety.

• Monitor and comply with the terms and conditions of the agreement with the Ministry of Labour designating Senior Investigators to be Provincial Offences Officers.

• Monitor trends and development in the field of compliance and fraud, waste and abuse prevention, detection, and enforcement through liaison with all levels of internal staff and a broad range of external contacts, participating in presentations, discussions, workshops, sharing of best practices, and joint investigations at the federal, provincial, regional and municipal levels; promote compliance and fraud awareness and prevention on behalf of the Board.

• Present information to Senior Management relevant to cases under investigation involving sensitive or highly confidential information. Attend Senior Management-briefing sessions alone or with the Executive Director to discuss case facts and options to be pursued and provide advice on the development of solutions or strategies.

• Be proactive and keep abreast of changes to jurisdictions, information systems, legislation, policy and process developments, strategies and projects to maintain currency with issues, developments, trends and best practices.

• Develop and maintain effective working relationships within the division and throughout the organization. Act as a technical resource to management and staff throughout the WSIB with respect to the Compliance Strategy, Offences and Penalties policies, and guidelines related to the handling of referrals to Regulatory Services for the prevention, detection or enforcement of noncompliance, fraud, waste and abuse.

How do I qualify?

Knowledge and Skills

1. Comprehensive knowledge of law enforcement and investigations, with extensive experience in this environment.

2. Well developed leadership skills to provide direction to staff and build, develop, coach and motivate teams

3. Knowledge of the Workplace Safety & Insurance Act, Criminal Code, FIPPA, Canada Evidence Act, and the Canadian Charter of Rights and Freedoms is essential.

4. Knowledge of project management techniques and skills required to plan, prioritize and lead projects

5. Knowledge of employment legislation, collective agreements and H.R. policies and procedures sufficient to ensure staff relations are conducted accordingly in the management of staff

6. Knowledge of MS Excel, MS Word, MS PowerPoint, to prepare memos, reports and presentations

7. Superior verbal and presentation skills to address and explain investigation outcomes to all levels of management at the WSIB.

8. Writing and editing skills to prepare and edit briefing notes, issue sheets and business cases, legal documents and Forms related to law enforcement such as Informations to Obtain Search Warrant, charging documents, Crown Briefs, Closure Reports.

9. Some requirement to travel to attend meetings, conferences, conduct speaking engagements.

Regulatory Services is made up of several teams. You will be required to manage one of the two teams of Senior Investigators. There are also additional teams, managed by other managers you will work with as part of a management group. The other teams consist of an Administrative Services team, consisting of Support Analysts who provide clerical support and administer the confidential tips line (the Action Line); an Investigative Services team, consisting of Compliance Specialists who review and analyze allegations of wrongdoing, request external surveillance assignments, and refer matters for investigation where appropriate; a Confirmation Unit (desk staff) and a Validation Unit (field staff), both of whom engage in administrative fact-finding to support compliance work; a Compliance Analytics & Metrics team, who provide data analysis and also outcomes and measures reports; a Prosecutions Team, consisting of Senior Prosecutors who prosecute offences in Provincial Offences court, when charges are laid under the Workplace Safety & Insurance Act by your Senior Investigators.
